New York man charged with spying on US-based pro-democracy activist groups for Chinese government

Federal authorities in New York have apprehended a Chinese dissident residing in the United States, alleging that he has been secretly collaborating with China's intelligence services and gathering intelligence on pro-democracy activist organizations. The U.S. Justice Department issued a press release detailing the charges against Yuanjun Tang, 67, who is accused of functioning and conspiring to function as an unregistered agent of the People's Republic of China (PRC) while also providing materially false information to the FBI. This case highlights the ongoing concerns regarding foreign influence and espionage within the United States, particularly in relation to individuals who have fled authoritarian regimes.

The allegations against Tang suggest that he has been engaged in espionage activities since 2018, operating under the directives of the Ministry of State Security (MSS) of China. Tang, who defected to Taiwan in 2002 after facing imprisonment for his protests against the Chinese Communist Party's one-party rule, later sought and was granted asylum in the United States, where he settled in New York City. Federal agents assert that from 2018 until approximately June 2023, Tang acted as an agent for the PRC, executing tasks assigned by the MSS. During the investigation, authorities reportedly uncovered various materials, including photographs, videos, and documents, which contained instructions from the MSS, further substantiating the claims of his involvement in espionage activities.

Federal authorities have reported that Tang provided materially misleading information to the FBI. He is accused of falsely asserting that he could no longer access an email account that had been used to communicate with his handler from the Ministry of State Security (MSS) through draft emails, raising concerns about the integrity of his statements during the investigation.

Tang faces serious legal repercussions, including one count of conspiring to act as an agent of a foreign government without proper notification to the attorney general, which could result in a maximum sentence of five years in prison. Additionally, he is charged with acting as an agent of a foreign government without notifying the attorney general, which carries a potential penalty of up to ten years, as well as one count of making false statements, also punishable by five years. Should he be found guilty, the determination of his sentence will be made by a federal district court judge, who will take into account sentencing guidelines and various statutory considerations. The investigation by the FBI remains ongoing.
